Because a standard commercial general liability policy excludes the one exposure that matters most at a track: injury to the participants — the riders. Off-road motorsport is treated by mainstream carriers as a high-hazard risk, so a generic business policy either declines the operation outright or quietly excludes participant injury, spectator crowds, and event exposure. Motocross track insurance is placed with specialty motorsports markets and built around participant liability, spectator liability, event coverage, and the property and staff exposures a real facility carries. It's coverage designed for how a track actually operates, not a generic policy with a motocross sticker on it.
General liability covers third parties — spectators, vendors, neighbors — who are hurt by your operation. It specifically excludes 'participants,' meaning the riders who voluntarily take part in the activity. Participant liability adds back coverage for bodily-injury claims brought by those riders. For a motocross track this is essential: the people most likely to be injured are the ones on the track, and a GL-only policy leaves every one of those claims uncovered. We treat participant liability as the core of a track policy, not an afterthought.
Waivers help, but they are not a substitute for insurance. A waiver can be challenged, ruled unenforceable, signed by a minor's parent in a state that limits such waivers, or simply not stop a lawsuit from being filed — and even a suit you eventually win costs real money to defend. Insurance is what pays your legal defense and any settlement or judgment when a waiver is contested or fails. The two work together: a strong waiver program reduces claims, and insurance protects the business when a claim comes anyway. Yes — selling or even furnishing alcohol at an event creates liquor liability (dram-shop) exposure that standard general liability excludes, and concession food sales add product liability. If there's a beer garden, a concession stand, or vendors at your events, we add liquor liability and concessions coverage so an alcohol- or food-related claim is actually covered.
